The court stated that the human rights groups had not shown that Israel violated legal prohibitions on starving a civilian population. The court also ruled that Gaza is not under a 'belligerent occupation' by Israel. The court found that at least two out of the three conditions for establishing a belligerent occupation have not been met by Israel. The court asserted that Hamas and other terror groups have hidden among the civilian population and seized humanitarian aid.
